A Turkey-based founder may be able to apply for a Mercury business account for a US company, but forming an LLC and receiving an EIN do not guarantee approval. The application must show who owns and controls the company, where the business is actually managed, what it sells, how it expects to use the United States market and why its address, website, contracts and payment flow tell the same story.

Short Answer

Mercury states that many US companies founded by non-US residents may apply. The applicant still needs an eligible US entity, formation and EIN records, identification for the control person and owners with 25% or more ownership, an acceptable principal business address and a credible description of current or planned US operations. Eligibility and prohibited-country rules can change, and every application remains subject to review.

For a founder living in Turkey, bank approval is only one part of the file. The same facts used for KYC should also match the company's US tax classification, Form 5472 or other federal filings, contracts, invoices, owner transfers and Turkish tax records.

Check Your File Before Applying

Use the bilingual review to separate the company, prior filing, owner-transaction and banking questions before documents are submitted.

If the company is foreign-owned and single-member, also use the focused Form 5472 Risk Check.

2027 Mercury Application Checklist

File What it should establish Frequent mismatch
Formation document Legal name, state and formation date Name differs from EIN or website
EIN confirmation Federal tax identity of the company Owner assumes EIN proves tax compliance
Passport or government ID Identity of the control person and qualifying owners Expired or inconsistent identity details
Ownership information Every beneficial owner at the required threshold Cap table and application percentages differ
Principal business address Where the business is actually operated Registered agent or mailbox used as operating address
Website and business description Product, customer and transaction model Generic website or unsupported US activity claim
Contracts and invoices Who sells, who pays and why Contracting party differs from bank account holder
Source-of-funds evidence Origin of initial and ongoing funds Owner contribution recorded as unexplained income
Expected activity Countries, counterparties and payment volume Activity changes sharply without supporting records

Mercury's published requirements distinguish a principal business address from a registered agent, P.O. box or certain mail-forwarding addresses. The application should therefore describe the real operating location, even when the company is formed in Delaware or Wyoming.

What Counts as US Operations?

Mercury asks applicants to describe existing or planned operations in the United States. A state formation certificate alone does not answer that question. Depending on the business, relevant evidence may include:

  • US customers or a documented plan to acquire them
  • Contracts with US platforms, vendors or service providers
  • A US marketplace or payment-processing need
  • A product offered to a genuine US user base
  • US inventory, fulfilment or supplier relationships
  • A venture or commercial structure that requires a US entity

The description should be specific and verifiable. A Turkey-based SaaS founder, an Amazon FBA seller and an investment-backed startup will not present the same operating model.

Address, Website and Contract Must Agree

A common failure is treating each document as an isolated form. Reviewers see one business file:

  1. The formation document identifies the legal entity.
  2. The EIN letter identifies the federal taxpayer record.
  3. The website explains the product and customer.
  4. The contract identifies the seller and payment obligation.
  5. The address shows where the business is operated.
  6. The ownership file identifies who controls the funds.

If the website says the business is operated from Turkey, the contract names a US LLC, the application uses a registered-agent address and owner transfers have no explanation, the file needs clarification before submission.

Banking Does Not Decide Tax Residence

A Mercury account does not make the income automatically US-only or tax-free in Turkey. For a founder living in Turkey, the following questions remain separate:

  • Who performs and manages the work?
  • Which person or company owns the customer relationship?
  • Is the US LLC disregarded, partnership-taxed or corporation-taxed?
  • Are owner contributions, reimbursements and withdrawals recorded correctly?
  • Does Form 5472, Form 1065, Form 1120 or Form 1040-NR apply?
  • How are the income and transfers reflected in Turkey?

The account is evidence of transactions. It is not a substitute for the legal and tax classification of those transactions.

First Funding and Owner Transactions

The first transfer into a new account is often the founder's own money. For a foreign-owned single-member US LLC, an owner contribution, owner-paid expense, reimbursement, loan or withdrawal may be relevant to Form 5472 analysis even when the company has no sales.

Keep a transaction log from day one with:

  • transaction date and amount
  • sending and receiving account
  • currency and exchange record
  • purpose of the transfer
  • supporting invoice, resolution or agreement
  • classification as contribution, loan, reimbursement, revenue or withdrawal

Before You Submit

  • Confirm the company is active and in good standing where required.
  • Match the legal name and address across state, IRS, bank and website records.
  • List the control person and qualifying beneficial owners accurately.
  • Prepare a plain-language explanation of the product, customer and US connection.
  • Collect formation records, EIN evidence and valid identification.
  • Explain the source of initial funds and expected payment corridors.
  • Check the current prohibited-country list immediately before applying.
  • Do not submit invented US operations or an address that is only a registered-agent location.
  • Map the 2027 federal, state and Turkey filing calendar before the account becomes active.

Evren Özmen's Assessment

The strongest application is not the one with the longest document pack. It is the one in which the entity, owner, address, product, customer, contract and source of funds describe the same business. For Turkey-based founders, the same consistency must continue after approval: bank movements, owner transfers, US information filings and Turkish records should remain reconcilable.

Request a Cross-Border File Review

Share the state and formation date, ownership structure, EIN status, product, website, customer countries, expected payment flow, principal business address and the founders' countries of residence through the contact form. The review separates bank-readiness issues from federal filing and Turkish tax issues.

Frequently Asked Questions

Can a founder living in Turkey open a Mercury account?

Mercury's published eligibility rules allow many US companies founded by non-US residents to apply. Approval is not automatic and depends on the company, owners, operating countries, documents and business model.

Is a registered-agent address enough?

Mercury distinguishes the principal business address from a registered agent, P.O. box or certain mail-forwarding arrangements. The actual operating address should be disclosed and supported.

Do I need an EIN before applying?

Mercury lists EIN documentation among its business-account requirements. The EIN identifies the business for federal purposes but does not complete the annual tax and information-filing obligations.

Does opening a US bank account remove Turkish tax?

No. The founder's residence, the place of management and work, the contracting party, income type and transfer model still need a Turkey-side analysis.

Is Turkey on Mercury's prohibited-country list?

Turkey did not appear on Mercury's published prohibited-country list at the last review date. The list and risk rules can change, so the live page must be checked immediately before an application.
